1. Purpose
These Terms of Service (the "Terms") govern access to and use of Yiropa (the "Service"), available at https://yiropa.org, operated by Yiropa with registered address in Zaragoza, Spain. The Service allows you to participate in daily anonymous polls and view aggregated results.
2. Acceptance
Accessing or using the Service means you fully accept these Terms and our Privacy Policy. If you do not agree, you must not use the Service. In accordance with Law 34/2002 (LSSI-CE), provision of the Service is subject to these Terms.
3. Capacity and Minimum Age
You must be at least 14 years old and have legal capacity to contract under Spanish law. By using the Service, you declare that you meet these requirements.
4. Registration and Account
You may register via Google OAuth or a magic link sent to your email. You are responsible for the accuracy of profile data you provide and for all activity on your account. Creating multiple accounts to manipulate results or abuse the Service is not permitted.
5. Permitted Use and Prohibitions
You agree to use the Service lawfully and respectfully. The following is prohibited: • Using bots, scripts, or automation to vote or alter statistics. • Attempting to identify other users or bypass anonymity mechanisms. • Harassing, threatening, or impersonating others. • Circumventing security measures, rate limits, or access controls. • Using the Service for unlawful purposes. Yiropa may suspend or terminate accounts that breach these rules.
6. Votes and Anonymity
Your votes are processed under a Privacy by Design model with rotating pseudonyms. Although Yiropa applies technical measures to protect anonymity, you acknowledge that no system offers absolute anonymity and you use the Service at your own risk.
7. Intellectual and Industrial Property
The Service, its design, brand, software, texts, and content are owned by Yiropa or its licensors and protected by intellectual and industrial property law. Reproduction, distribution, or transformation without express authorisation is prohibited.
8. Data Protection
Personal data processing is governed by our Privacy Policy, available at https://yiropa.org/legal/privacy, in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).
9. Disclaimer of Warranties
The Service is provided "as is" and "as available". Yiropa does not guarantee uninterrupted operation, absence of errors, or fitness for a particular purpose. Aggregated results are for informational purposes only and do not constitute professional, legal, medical, or other advice.
10. Limitation of Liability
To the extent permitted by law, Yiropa shall not be liable for indirect damages, loss of profit, data loss, or harm arising from use or inability to use the Service. Yiropa's total liability, if any, shall be limited to EUR 100, unless mandatory consumer protection law provides otherwise.
11. Termination
You may delete your account at any time from the in-app menu. Yiropa may suspend or terminate access if you breach these Terms or where required by law. Upon termination, your right to use the Service ends immediately.
12. Minors
The Service is intended exclusively for people over 14 years of age. By using Yiropa, you declare that you are over that age. Yiropa does not perform technical age verification and is not responsible for the accuracy of this declaration. If you are aware that a person under 14 has accessed the platform, please notify yiropa.org@gmail.com so we can proceed with the immediate deletion of any related data.
13. Governing Law and Jurisdiction
These Terms are governed by Spanish law. For dispute resolution, the parties submit to the Courts of Zaragoza, Spain, unless mandatory consumer law assigns jurisdiction elsewhere.
14. Modifications
Yiropa may modify these Terms to reflect legal or Service changes. The current version will be published on this page. Continued use of the Service after publication constitutes acceptance.
